§ 9-208.7. City council action upon appeal

After a hearing and consideration of the report and recommendation of the director, and any written materials submitted by the applicant or other affected person(s), the city council shall either grant the permit, grant the permit with conditions, or deny the permit upon determining that issuance thereof would result in any one of the circumstances set forth in section 9-212. The decision on appeal by the city council shall be based on written findings, shall be final and conclusive on the matter, and subject to review pursuant to California Code of Civil Procedure section 1094.6 or 1094.8.
